DA Drops Charges Against Mark Anthony Cassell, Man Accused of Killing Newspaper Vendor

The District Attorney's Office has dropped charges against the man accused of pushing down 77-year-old Dallas Ayers and killing him.

DA Spokesman Alex Bastian told us that the case has been discharged, but inspectors are still actively investigating the incident.

"Inspectors are in the process of completing their investigation," Bastian told SF Weekly. "We can only charge cases if we have a good-faith basis to believe we can prove the case beyond a reasonable doubt."

On Monday, police said they had arrested 36-year-old Mark Anthony Cassell in San Francisco after cops at the Tenderloin Police Station recognized Cassell through a crime bulletin. Cassell was booked into San Francisco County Jail on murder charges.

On January 28, 2013 at approximately 11 a.m. Ayers was in front of 1 Post Street when the suspect approached him, wrapped his arms around his waist, picked him up in the air, and dropped him down onto the ground, then fled the scene.

Ayers was taken to the hospital where he died three weeks later from his injuries.

However, Cassell is not yet a free man; Bastian says that he's being held in custody for unrelated petty theft and drug charges.
