Tracy Luong: Woman Arrested Again on Suspicion of Beating UCSF Medical Student to Death

Police say they have arrested a second suspect in the beating case of Joe Oliveras Hernandez, a UCSF medical student who was attacked while at a nightclub in SOMA three years ago.

Tracy Luong, 25, was re-arrested on Sunday after she turned herself into police, said Officer Albie Esparza. Luong, a San Jose resident, had been arrested in May 2011 in connection to the beating but was later released after the District Attorney's Office dropped the case against her.

When she was arrested in 2011, police charged her with aggravated assault, saying she was the female suspect who struck a man in the head and face with her high-heel as he tried to intervene when Hernandez was being beaten.

But Alex Bastian, spokesman with the DA's Office, tells us that the assault victim was not available to help build a case against Luong at that time, thus the charges were dropped.

"At the time of the underlying case of assault against the female defendant, the victim was unavailable due to military engagement and was out of the country at the time of trial," Bastian says. "Since then, the SFPD along with the SF District Attorney's office uncovered the second suspect's name, and established a nexus between the two suspects. That led to both defendants being arrested and charged with involuntary manslaughter."

This time, Luong has been charged with involuntary manslaughter, assault with a deadly weapon, and battery causing serious bodily injury.

Last week, police arrested 36-year-old Dung Minh Nguyen on suspicion of beating 30-year-old Hernandez to death. Nguyen was arrested on Jan. 9, three years to the day after the attack.

Hernandez was out with a classmate at Temple Nightclub when he was beaten by a man he reportedly didn't know. He was knocked into a coma and died a few days later.
