New HIV Case Prompts Porn Moratorium

The Free Speech Coalition has called for an industry-wide moratorium on adult film production after a performer received a positive test for HIV. 

"There was a positive test at one of our testing centers," said FSC CEO Diane Duke. "Confirmatory tests are not yet back but we are taking every precaution to protect performers and to determine if there's been any threat to the performer pool." 

The moratorium comes just two weeks after a bill that would have required adult film performers to use condoms on set was shelved in the California Senate. The bill, AB 1576, faced wide opposition by the porn industry, which argued that its STI testing system, known as PASS, is can prevent STI transmissions on film sets. 

Duke says that the performer will need to undergo confirmatory tests. The FSC will then work to determine an infection timeline and identify any sexual partners the performer has had. 

"We take the health of our performers very seriously and felt that it was better to err on the side of caution while we determine whether anyone else may have been exposed, " Duke said. "The performers' health and safety is the most important thing." 

The industry was last shut down by a moratorium one year ago, when several performers tested positive for HIV in July 2013. In response, the FSC changed its testing protocol, requiring performers to take STD tests every 14 days instead of every 28 days.

Like the current moratorium, the July 2013 industry shutdown followed the failure of legislation that would have required condom use on porn sets.

On Twitter, some performers expressed relief that the moratorium happened after the failure of AB 1576, so that the positive HIV test could not be used as political leverage to pass the bill:
